91 (1) There is created the Joint Commission on Recommendation, which shall be charged 92 with recommending and proposing for a vote by a constitutional majority the nullification 93 in its entirety of a specific federal law or regulation which is deemed to be outside the 94 scope of the powers delegated by the people to the federal government in the United 95 States Constitution or at odds with the Georgia Constitution;
and
104 (3) The commission of recommendation shall have the power to review any and all 105 existing federal statutes, mandates, and executive orders for the purpose of determining 106 the constitutionality thereof, and such commission may recommend existing federal 107 statutes, regulations, mandates, and executive orders put in place prior to the passage of 108 this resolution for nullification. The commission shall respond with its recommendations 109 within 30 days of receiving such federal legislation for consideration; and 110 (4) Upon recommendation for nullification, the General Assembly may vote to nullify 111 following such recommendation. The appropriate documentation reflecting the vote shall 112 be documented in legislative journals of the House and Senate. In the event the General 113 Assembly votes by a constitutional majority to nullify any federal statute, mandate, or 114 executive order on the grounds of constitutionality, neither the state nor its citizens shall 115 recognize or be obligated to live under such statute, mandate, or executive order.

In order to restore the appropriate balance of power between the states and the federal government, ALEC is launching “Restore the Balance: An Initiative to Restore Federalism in America.” This Initiative will focus on advancing ALEC’s guiding principles of limited government and federalism by providing state legislators model legislation for their states and model resolutions for petitioning the U.S. Congress that will help to protect their states’ Tenth Amendment rights. Our goal is to restore our founding fathers’ intent that the states would enjoy co-equal status with the federal government.

For those who are unfamiliar with ALEC, it is the American Legislative Exchange Council (founded by Paul Weyrich in 1973) which is made up of conservative state legislators and corporate executives such as the Koch brothers. They should explain why, if the Founding Fathers intended that the state and federal governments to be equal, did they add the general welfare, commerce, and supremacy clauses to the Constitution. The Framers wrote the Constitution to replace the Articles of Confederation because they realized a confederation of sovereign states and an impotent federal government is unworkable.In July 2011 the Nation magazine published an exposé of ALEC's secret model bills the magazine obtained from a whistle-blower. This is just Johnny Reb rearing his ugly head again. Some people in the South still can't reconcile themselves to the fact that they lost the Civil War. They probably want to get their slaves back too.
There was a Nullificaton Crisis back in the 1830's, I believe (I could be off by ten years) this was among the first Sectional rumblings that eventually led to the Civil War. The main perpetrator was South Carolina back then and that state was the first to secede and fired the opening shots of the Civil War.

This is so phoney. The vast majority of federal requirements are tied to federal money. For instance, highway funds are doled out to the states each year, and with those funds come federal standards for building roads. If the states do not want federal "intrusion" into their business, they can simply forego the money. How much more simple can it get?
Who remembers the federal 55 mph speed limit? States were 'required' to post and enforce the law. If they did not, they risked losing their federal highway funds. That is all. No imprisonment, no fines or any other consequences for the states. Every single state voluntarily surrendered their sovereignty in exchange for highway funds.
Unemployment funds? Tell the feds to keep them.
Education funds? Tell the feds to pound sand!
Police and fire protection funds? Send a message, loud and clear.
If you take the king's coin, you will do the kings bidding. End of story!
Until the states, and the pandering politicians in them, give up the federal money, I think they ought to just shut up!
