I found this interesting: The court ruled that the mandate is unconstitutional, but it can stay as part of Congress's power under a taxing clause. The court said that the government will be allowed to tax people for not having health insurance. "The Affordable care act's requirement that certain individuals pay a financial penalty for not obtaining health insurance may reasonably characterized as a tax. Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness," the court said in the ruling.

I understand the Court found the individual mandate as Constitutional due to its being a tax. Beyond that, having interacted with Wingos in times past, I would be concerned with what the Right will do about this. I wouldn't be at all surprised if fundagelical preachers this Sunday thunder down with sermons to "pray the Court home" (i.e. dead). The judiciary, not being an arm of the Church, is going to garner lots of hostility.

I would argue that it very well could have happened if anyone in the white house or upper levels of Congress actually fought for it, which they didn't. Instead, people may now be 'taxed' if they do not hand their money over to private insurers, who are run by some very rich people who will be more than happy to become wealthier.
