I think this is interesting to discuss. In Maryland, two physicians are being held for performing late term abortions---held for murder under the "killing a viable fetus" law which had been originally used against murderers who murdered pregnant women, resulting in the death of fetuses deemed "viable". There are a lot of problems with this, the first being that it is patently and obviously unconstitutional.

Since abortion is a legal medical procedure and since a fetus is not recognised in law as a person, murder is an inappropriate charge. Ther may, however, be other possible charges. The courts will throw out a charge of murder.

Completely unconstitutional. It's a matter of time before any conviction is thrown out.
