For once, you and I are in agreement. Clinton should have vetoed it and dared Congress to override him. Singing it was arguably a bigger moral lapse than his dalliance with Monica.

And the fact is that in both Golinski and Perry, the stays of the judgments can no longer be considered proper. Such discretionary stays are granted upon a supersedeas in which the movant must show that irreparable harm would result if the ruling were implemented and there were a reversal upon appeal. In both Golinski and Perry, harm is exactly what the defendants were unable to show in court. In the right-to-marry case, there are already 18,000 Californian same-sex couples who are married, and tens of thousands more other states. It is the delay in granting same-sex couples the right to get a marriage license and to have full benefit of the federal laws that results in irreparable harm, particularly given how these two cases work together. I have no doubt that if Golinski were about a law that took thousands of dollars directly out of the pockets of married heterosexual parents every year, there would never have been a stay in the first place.

The courts should err on the side of rights, rather than on the side of withholding rights.

Ten years from now, gay couples will be getting married, and nobody will notice.
