Would anyone care to explain something to me?
Bachmann: Obama Like A 'Dictator' If 14th Amendment Invoked In Debt Fight
Exactly *how* would Obama be 'out of line' if he invokes the 14th Amendment in an effort to come to a resolution regarding the current debt crisis?

4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.
The president is being encouraged by some of Congress to invoke this amendment on the grounds that defaulting on the country's debts would go against the Constitution. The idea that some Democrats are operating under is that the text of this amendment gives Obama the right to make a unilateral decision to protect US' credit if the need were to arise. However, here are two quotes from Michelle Bachmann in the above article:
"Congress has the power to lay and collect taxes. It's Congress that does the spending," Bachmann said on CNN. "The president is prohibited to do that. If he had the power to do that he would effectively be a dictator."
"There would be no reason for Congress to even come to Washington, D.C.," Bachmann said of the possibility. "He would be making the spending decisions. He would be making the taxing decisions. Clearly that's unconstitutional."
From from the text of the amendment (and traditional interpretation of same), it appears that Obama is well within the scope of his job to decide how the debts incurred by the US will be paid, because not paying them is not an option. How would this make Obama a 'dictator'?
I guess a second question should be asked here, too. Why does anyone pay any attention to Michelle Bachmann at all? I suppose you could probably ask the same question about me since I too will say things that aren't fully 'on the mark', but I don't do so in front of cameras. No, I just do it in blogs on Beliefnet. :) But at least I'm not running for president.

"5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article." THE CONGRESS not the President has the power to enforce the provisions of this article. Also, section 4 of the article is talking about the VALIDITY of the debt of the U.S. and the fact that it shall not be questioned. If we default we still owe the debt and the debt is still valid. We just can't pay it. The section goes on to say that debt incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave, shall be held illegal and void. In other words the Federal or State governments are not responsible for loans taken out by the southern states to fight the civil war or for loss claims coming from the emancipation of the slaves. NOTHING about this Amendment allows the President to do anything or force Congress to write any check. Just my humble opinion.
